Why your check is stuck
- County courts that still run on paper. A handful of US counties process record requests manually; one slow courthouse holds the whole report even when every database search cleared in minutes.
- A common name. John Smith with no middle name triggers manual review to rule out records belonging to other John Smiths — adding days, through no fault of the candidate.
- Unverifiable history. A defunct past employer, an overseas university, a registrar on summer break: verifications stall on whoever has to answer the phone at the other end.
What employers can do to speed it up
Three levers, in order of impact: order only the searches the role needs (every extra county search is another courthouse queue); collect the signed consent form with the application, not after the offer — that alone saves the most common day of dead time; and pick a provider with direct county-court integrations rather than one that subcontracts the slow counties. What you cannot speed up: a courthouse that processes by hand.
The candidate's view
Candidates see a consent request first, then status updates, and they're entitled to a copy of the report. If something looks wrong, the FCRA gives them a dispute right the employer must respect — adverse action requires notice, a copy of the report, and time to contest it.
